Senaradioonline.com can authoritatively confirm that the Council of state has begun consultations on petition for the removal of the Chief Jistice Gertrude .

The consultations by the Council of state according to our source follows the submission of the Chief Justice’s responses to the President on Monday April 7, 2025, which marks exactly the day the 10 day window granted her by the President.

It would be recalled that the petitions received by the President earlier last month and triggered national attention, prompting legal and constitutional debates on the appropriate procedure for handling such matters.

Justice Torkornoo, in a letter addressed to the President a few weeks ago, had requested copies of the petitions and asked for at least seven days to respond, in line with the requirements of due process and fairness.

Her response submitted to the President is what has occasioned the consultations by the Council of State, under Article 146(6) of the 1992 Constitution to consider a prima facie or not in the 3 petitions based on which it (Council of state) will recommend the constitution of a committee to investigate the allegations against the Chief Justice.

Our sources at the Flagstaff House confirmed to www.senaradionnline.com that the consultations began this morning and information is rife that the Council of state would as part of their recommendations trigger the establishment of the Committee to investigate the Chief Justice.
When that happens as per the intelligence we’ve picked, the Chief Justice will be Suspended by the President pending the investigation

The law that surrounds the removal of the Chief Justice is enshrined in Article 146 of the constitution.

The Law per clause (10) states as follows: Where a petition has been referred to a committee under this article, the President may-
(a) in the case of the Chief Justice, acting in accordance with the advice of the Council of State, by warrant signed by him, suspend the Chief Justice.

With calls by legal luminaries like Lawyer Ansa Asare, former Director of Ghana Law school for the Chief Justice to be suspended if prime facie is established, it is not clear whether the Chief Justice would escape suspension if indeed prime facie is established.

Meanwhile, the Supreme Court is set to hear a suit on April 9, filed by Old Tafo MP Vincent Ekow Assafuah, challenging the legality of the President initiating the removal process without first notifying the Chief Justice.
